Kohler Mira settles design case against Triton

Shower manufacturer Kohler Mira has reached an out-of-court settlement with Triton Showers which will see all versions of the latter’s Inscriptions shower removed from the market.

Kohler Mira started an action against rival Triton in respect of design infringements relating to Mira’s Azora and Galena electric showers.

As a consequence of the settlement, Triton has a deadline of the end of March 2011 to withdraw all versions – whether proprietarily or own-branded for retailers – plus make good Mira’s legal costs.

Dave Hill, Managing Director of Mira Showers, said of the agreement, “Each year, Mira Showers invests significantly in intellectual property and new product development. As industry leader in innovation, we cannot and will not allow our investments to be misappropriated through infringement”.

“It should not be underestimated as to how aggressively we will seek to enforce our intellectual property rights in the markets in which we operate.”
